I. BASIC PROVISIONS

  1. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, a network identifier, or by reference to one or more specific elements of that natural person’s physical, physiological, genetic, psychological, economic, cultural or social identity.
  2. The operator has not appointed a data protection officer.

II. SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA

  1. The controller processes personal data that you have provided to it or personal data that the controller has obtained on the basis of the fulfilment of your order.
  2. The operator processes your identification and contact data necessary for the performance of the contract.

III. LEGAL REASON AND PURPOSE FOR PROCESSING PERSONAL DATA

The lawful reason for processing personal data is

  1. Performance of the contract between you and the operator pursuant to section 13(1)(b) of the Act,
  2. The legitimate interest of the controller in the provision of direct marketing (in particular for the sending of commercial communications and newsletters) pursuant to § 13 (1) (f) of the Act,
  3. Your consent to processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to § 13 (1) (a) of the Act in the absence of an order for goods or services.

The purpose of processing personal data is

  1. Performance of your order and the exercise of the rights and obligations arising from the contractual relationship between you and the operator; when placing an order, personal data are required that are necessary for the successful processing of the order (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or to perform it on the part of the operator,
  2. Sending commercial communications and carrying out other marketing activities.

There is no automatic individual decision-making on the part of the controller within the meaning of Section 28 of the Act.

IV. PERIOD OF RETENTION OF PERSONAL DATA

Provider retains personal data

  1. for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from that contractual relationship (for a period of 15 years from the termination of the contractual relationship).
  2. for a period of time before consent to the processing of personal data for marketing purposes is withdrawn, up to a maximum of 10 years if the personal data is processed on the basis of consent.
  3. On expiry of the retention period, the controller shall erase the personal data.

V. RECIPIENTS OF PERSONAL DATA (SUBCONTRACTORS OF THE PROVIDER)

Personal data recipients are persons

  1. Participating in the delivery of goods/services/making payments under a contract,
  2. providing e-shop operation services and other services in connection with operating, improving and analysing the e-shop,
  3. providing marketing services.

The controller does not intend to transfer personal data to a third country (non-EU country) or to an international organisation. Recipients of personal data in third countries are providers of mailing services, cloud services and analytics services.

a) Description and scope of data processing

This website uses the “Google Analytics” service provided by Google Ireland Ltd (Gordon House, 4 Barrow Street, Dublin, Ireland) to analyse the use of the website by users. This service uses “cookies” – text files stored on your computer. The information collected by cookies is usually sent to a Google server where it is stored.

IP address anonymisation is used on this website. The IP addresses of users within EU member states and the European Economic Area are truncated. This truncation eliminates personal reference to the IP address. Within the framework of the data processing agreement we have concluded with Google in connection with orders, Google uses the collected information to analyse the use and activity of the website and to provide services related to the use of the Internet.

The legal basis for this processing is Article 6(1)(f) GDPR. We have entered into an order processing contract with Google.

c) Purpose of data processing

Google uses this information on our behalf to analyse website usage, to compile reports on website activity and to provide other services related to website and internet usage. The IP address sent by the browser via Google Analytics is not linked to any other data held by Google.

d) Retention period

Google retains the data for 26 months. No personal data is retained for short forms of IP addresses.

e) Objections and removal of data

You have the option to prevent cookies from being stored on your device by configuring your browser accordingly. If your browser does not allow cookies, there is no guarantee that you will have unrestricted access to all features of this website. In addition, you can use a browser add-on to prevent the information collected by cookies (including your IP address) from being sent to Google. And to be used by that company. 4. YouTube

Our website uses videos from YouTube, LLC 901 Cherry Ave., 94066 San Bruno, CA, USA, which is owned by Google Ireland Ltd. (Gordon House, 4 Barrow Street, Dublin, Ireland). In doing so, we apply the “enhanced data protection mode” option made available by YouTube. By loading one of our pages via the YouTube video service, content from YouTube is loaded. If you are logged into your YouTube account, YouTube has the option to combine your browsing behaviour with other data. VI. YOUR RIGHTS

Under the conditions set out in the Act, you have

  1. the right to access your personal data under section 21 of the Act,
  2. the right to rectification of personal data pursuant to Section 22 of the Act, or restriction of processing pursuant to Section 24 of the Act,
  3. the right to erasure of personal data pursuant to Section 23 of the Act,
  4. right to object to processing pursuant to Section 27 of the Act,
  5. right to data portability pursuant to § 26 of the Act,
  6. the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms and conditions.
  7. You also have the right to lodge a complaint with the Data Protection Authority if you believe that your right to the protection of personal data has been violated.

VII. Personal Data Security Terms

  1. The operator declares that it has taken all appropriate technical and organisational measures to secure personal data.
  2. The operator has taken technical measures to secure data storage and storage of personal data in paper form
  3. The operator declares that only persons authorised by it have access to personal data.
